  2. HOW WE USE YOUR INFORMATION

    We process your personal data under strict legal bases, including the fulfillment of contracts and compliance with state and federal laws:
    • Account Activation & Fraud Prevention: To verify your identity, age, and payment authorization before granting active bidding privileges.
    • Transactional Workflows: To generate automated auction win notices, process your immediate $500.00 non-refundable deposit, and issue final vehicle balances.
    • Legal & DMV Compliance: To execute mandatory state titling, registration, and tax paperwork with the New York State Department of Motor Vehicles (NYS DMV).
    • Automated Communications: To deliver critical transaction updates via email or SMS regarding your strict 24-hour inspection windows, payment deadlines, and vehicle removal schedules.
  3. SHARING AND DISCLOSURE OF DATA

    Power Motor Group, Inc. does not sell, rent, or trade your personal information to third-party marketing companies. We only share data with trusted entities essential to completing your transaction:
    • Payment Processors: Financial details are securely transmitted directly to our PCI-compliant third-party payment gateways to process deposits and balances.
    • Government & Regulatory Agencies: We share identity and transaction data with the NYS DMV and law enforcement entities to comply with Title Attached (TA) regulations, odometer disclosures, and anti-theft statutes.
    • Legal & Arbitration Providers: In the event of a contractual default, non-payment, or dispute, data may be shared with our legal counsel and JAMS Arbitration administrators in New York City.
  4. DATA SECURITY AND RETENTION

    • Encryption Protocols: We employ industry-standard Secure Sockets Layer (SSL) and Transport Layer Security (TLS) encryption to protect data transmitted through bidsales109.com.
    • Dealer Licensing Compliance: Pursuant to New York State holding regulations for licensed auto dealers (License #7116266), we are legally required to retain transaction records, bills of sale, and buyer identity logs for a mandatory multi-year period. Your data will be deleted or anonymized once these statutory compliance windows expire.

    • SMS/Email Opt-Out: You can opt out of promotional communications. However, because our auction system relies on automated time-sensitive deadlines, you cannot opt out of operational transaction emails (such as Invoice and Deposit notices) while maintaining an active bidding account.
